JBS USA Sanitation Faces Class Action Over Labor Code Violations
A new class action lawsuit filed in Riverside County Superior Court accuses JBS USA Sanitation Corporation of systemic labor violations, including the denial of mandatory meal and rest breaks. The complaint, brought by Blumenthal Nordrehaug Bhowmik De Blouw LLP, alleges the company systematically underpaid workers and manipulated timekeeping records.
The scope of the allegations extends beyond break violations to include failures in wage compensation. Plaintiffs assert that the company neglected to provide accurate itemized wage statements, failed to pay overtime and minimum wages, and did not reimburse employees for necessary work-related expenses. The suit outlines a pattern of non-compliance with multiple sections of the California Labor Code, including sections 201-203, 226, and 512, which govern wage payment, sick leave, and rest period requirements. Employees reportedly worked shifts of varying lengths—ranging from two to over ten hours—without receiving the state-required ten-minute rest periods.
